Policies/Liability/Risks
Booking/Cancelling/Rescheduling Policies:
- 50% retainer required to book your photo-shoot. $
- Retainers are non-refundable: Client acknowledges and agrees that the retainer amount set out above is due upon the signing of this Agreement and is not refundable, so as to fairly compensate Photographer for committing his/her time to provide the Services and turning down other potential projects or clients. Both parties agree that the Retainer will be credited towards the total Fees payable by Client.
- Client may Cancel and/or reschedule the Services by providing Photographer with written notice no later than 5 business days before the original date of the Portrait Session. Client acknowledges and agrees that Client will not receive refund of Retainer for Cancellations and Rescheduling unless the Minimum Notice is duly provided or unless the parties otherwise agree in writing.
Fees and Payment

Photographer Exclusivity:
- No other photography is permitted during your photo-shoot unless approved with a mutually agreed upon contract ahead of time. This includes personal cameras and cellphones.
Photo Delivery Policies:
- You will receive your images as a link to an online photo gallery.
- The images in your gallery will be images selected by your photographer as the best images from your session and will already be professionally edited.
- The link to the online gallery will be provided once full payment is received.
Refund Policy:
- Refunds will not be given unless a service was not performed.
Copyright and Social Media Policies:
- The photographer reserves all copyrights to the images taken unless stated otherwise in a mutually agreed upon contract.
- The photographer retains the right to use any images from the photo-shoot for professional purposes, including portfolios, displays, website content, advertising, exhibitions, competitions, and other promotional uses, unless otherwise agreed to in writing.
- Clients may not alter the photographs in any way, this includes cropping, and filters. If you require anything different from your photos i.e.: different format size, please let us know and we will be happy to accommodate.
- If you are posting or sharing any photo on social media without a watermark, please give credit to the photographer in the form of a tag to our social media account or website ie: facebook.com/allmemoriesphotography.
Acknowledgment of Risks:
The Client acknowledges that participating in a photography session may involve inherent risks, including but not limited to:
- Physical injury (e.g., slips, falls, environmental hazards)
- Emotional discomfort
- Damage to personal property
- Risks associated with outdoor locations, weather, wildlife, or uneven terrain
The Client voluntarily assumes all such risks.
Waiver and Release of Liability:
In consideration for being permitted to participate in the photography session, the Client agrees to release, discharge, and hold harmless Allmemories Photography, its owner, employees, contractors, and representatives from any and all claims, demands, damages, or causes of action arising out of or connected with:
- Participation in the session
- Use of the photographs
- Any injuries, losses, or damages to the Client or their property
This release applies to all known and unknown risks, whether caused by negligence or otherwise, to the fullest extent permitted by British Columbia law.
Client Responsibility:
The Client agrees to:
- Follow all reasonable instructions provided by the Photographer
- Ensure their own physical safety and the safety of any minors or pets they bring
- Secure their personal belongings
- Disclose any relevant limitations, sensitivities, or concerns prior to the session
Hold Harmless:
The Client agrees to hold harmless the Photographer from any liability, loss, or expense (including legal fees) arising from:
- The Client’s actions during the session
- Claims brought by third parties related to the Client’s participation
Minors:
- If we are commissioned to do a photo-shoot by a minor, the parent or legal guardian of the minor needs to be present at the photo-shoot or have confirmed with us in writing that they are aware of the photo-shoot and authorize the photo-shoot to move forward.
Location:
- Photographer must follow the rules of the venue/location and will not break the rules of said venue/location in order to get a requested shot for the client.
